Do I really need a trust for my Arizona LLC?
An LLC by itself does not avoid probate. If you own the LLC personally and you die, the membership interest goes through probate court before anyone — including your spouse — can act on behalf of the company. Holding that interest in a revocable trust solves the problem.
Funding the trust correctly takes a few steps: assign the membership interest, update the operating agreement to recognize the trust as the member, and update any banking signature cards. None of these are hard. Almost none of them are done right when an attorney drafts the trust without looking at the LLC paperwork.
